Marathas Community brought under EWS Quota in Maharashtra

The tripartite Maha Vikas Aghadi (MVA) government in Maharashtra on 01st June 2021 announced that the Maratha Community can now avail benefits under the Economically Weaker Section (EWS) quota.

Previously, the government had decided that the Socially and Economically Backward Class (SEBC) i.e. Maratha community, could not take the benefit of the 10 percent EWS category as the Maratha reservation was in force in the state. The Supreme court, however, scrapped the SEBC reservation in jobs and education, making it possible for the State government to extend the benefit of the EWS quota to the Marathas community. The General Administration Dept (GAD) had issued a govt order to put this effect.

SEBC Reservation in Education and Jobs to EWS

As per the government resolution, an individual fulfilling the criterion for Economically Weaker Section if comes from the castes not described as backward by the State laws will be eligible for 10 percent reservation benefits in educational institutes, barring minority institutes. This will be also be applied to State govt recruitment. It also said that the said reservation will be above the existing reservation.

The GAD govt order stated that the SEBC community belonging from the period of interim stay on Maratha reservation on 9th September 2020, till the scrapping of reservation by the Supreme Court on 5th May 2021. Candidates from the SEBC community whose appointments were pending before the interim stay on the Maratha community reservation will only be eligible for the EWS quota and not be applicable to those who benefitted in appointments and admissions under the Maratha reservation, the government order further stated.

The government has clarified that in case of non-availability of eligible candidates under the Economically Weaker Section (EWS), the post will be filled from the open category based on merit.

Who is eligible?

The central government had decided in 2019 to give 10 percent reservation in education and jobs to EWS class students and candidates. Individuals with an annual income of less than Rs. 8 lakh can get education and job reservation under the EWS category. The law stipulates that the family farm of persons eligible for the reservation should not exceed 5 acres.
